Legal stuff
These General Terms and Conditions (GTC) govern all services and payments that are incurred within the scope of the contractual relationship to be concluded.
Placing an order
Offers are made in writing and are valid for six weeks. By placing the order, the Client accepts the GTC.
Services
Depending on the order, the Contractor shall undertake the translation, preparation and proofreading of German and English texts. The exact scope of services results from the offer accepted by the Client and the written order confirmation that follows. All services are performed with the utmost of care.
Payment
Unless otherwise agreed, payment shall be made against invoice and without deductions within ten days of the invoice date.
Confidentiality
The Contractor undertakes to keep all contents of an order confidential. If necessary, contents may be passed on to participating collaboration partners and service providers to the extent necessary for the fulfillment of the order. The Contractor shall ensure that her cooperation partners and service providers are under a corresponding obligation to maintain confidentiality.
Limitation of liability and claims for defects
A guarantee for complete faultlessness is generally excluded. Should an edited text show defects despite all care and diligence, the Client is obliged to report this. The Client has the right to free rectification of defects or a price reduction. Otherwise, the services rendered shall be deemed to have been approved. Further claims are excluded. Any liability of the Contractor for consequential damages or defects of any kind shall be excluded as a matter of principle. The Contractor cannot be held liable for the electronic or postal dispatch of texts.
In the case of the translation of legal texts, the contract is only for a translation service. The Contractor translates the content of the text into the other language according to its wording. She is not a legal expert and does not provide legal advice. Therefore, the Contractor does not guarantee that the content and legal implications of the translation are identical to those of the original text. Any claims of the Client against the Contractor arising from any legal consequences of the translation of legal content are excluded. Liability of the Contractor for damages resulting from injury to life, body or health as well as for intentional or grossly negligent misconduct is neither excluded nor limited by these GTC with respect to amount.
Approval
The final approval of texts for publication and printing rests with the Client.
Data protection
The provisions of the EU GDPR apply to all contracts. The confidential treatment of documents and information provided by the Client shall be ensured by the Contractor within the scope of normal working practices. We point out that personal data will be stored within the scope of the execution of the contract and may be forwarded to participating collaboration partners and service providers to the extent necessary. The Client is aware that all participants in the Internet data transfer processes may gain knowledge of data in transmission without authorization. The Client accepts this risk.
Final provisions
Additional agreements to the GTC must be made in writing. German law applies to all disputes. Place of jurisdiction is Augsburg, Germany.
Severability clause
The invalidity of one or more of the above provisions shall not affect the validity of the remaining provisions. The parties undertake to replace the invalid provision with a corresponding valid provision that comes closest to the intended provision in economic and legal terms.
